Template: Commercial Property Lease: office building

Template: Commercial Property Lease: retail unit or shop

"This lease is for letting a shop, restaurant or cafe where there is no requirement for service charge recovery. The unit may be one of a row, with or without high street frontage, or stand-alone. It may be just a retail space or it may have offices or other business space attached as well. The shop may or may not have additional space used by the tenant for other business purposes, such as offices, storage or a commercial kitchen. This lease does not cover additional space used for residential use by the tenant, although we do provide one that does (see below)."

It allows for use of any buildings or items of plant on the land, such as site offices. Template: Commercial Property Lease: land for car or lorry park

"This is a lease to let a plot of land that the tenant will use to park and store vehicles - most likely cars, vans or lorries. It is a tailored version of our less specific land lease. The agreement allows for existing buildings or items of plant (e.g. an office or a car wash) to be included.  Uses for the land might include:

  • car parking near to an airport
  • as a storage ground for a vehicle dealership
  • as a sales yard for agricultural vehicles
  • overnight lorry parking

The lease is designed to maximise the capital value of the land in order to provide acceptable security to a lender. We prioritise the landlord’s interest over the tenant’s."

Template: Commercial Property Lease: unit on industrial estate or business park

"This document should be used to let an industrial unit such as a workshop, factory, depot or warehouse that shares common facilities and services with other units let by the landlord to different tenants. Commonly, this lease would be used for a unit on a small- to medium-sized estate, whether industrial or commercial in nature. Paragraphs within the lease provide for recovery of service charges such as for security, access, and utilities."

Template: Mixed Use Property Lease: shop or commercial unit with residential space

"This is a comprehensive lease for letting a mixed use unit comprising of retail and residential space. The retail space could be used for any purpose, including as a shop, a restaurant, a cafe or for services. The lease provides for the residential space to be part of the business letting, regulated by the Landlord and Tenant Act 1954 and not the Housing Act 1988. The agreement includes an extensive menu of tenants' covenants to protect every aspect of the landlord’s interest."

Sublease Agreement for Commercial Property: landlord involvement

"This sublease includes optional provisions that give the head landlord additional rights when dealing with the subtenant. It can be used to sublet part of or the whole of any commercial property, including offices, shops, industrial units such as factories, warehouses and workshops, and land. Your sublease can follow or deviate from the original terms as much as you like. You could carve out the sublease from the head lease with the same terms, or alternatively, specify different terms and impose further obligations on the new tenant.  Typically, this document would be used by the head landlord (perhaps in conjunction with the original tenant) to sublet:

  • the whole of a property to a single new tenant so that the original tenant is effectively replaced by the new subtenant

  • part of the property to a subtenant, while the original tenant continues to occupy the rest

  • the whole property, split into separate units, to multiple tenants (perhaps at relatively higher individual rents so that the original tenant profits)"

Commercial Property Licence: to occupy business premises

Read what Net Lawman says about this template:

"This licence agreement provides the legal framework to let spare office rooms, workshops or other business space to other businesses without creating a lease under the Landlord & Tenant Act 1954. That it doesn't create a lease will be the most important feature for most users. A lease creates an interest in land and gives the tenant additional rights - particularly with respect to stay in the property when the lease term expires (security of tenure). A licence agreement does not give the occupier the same rights to stay.  This agreement includes minimal and usual provisions in simple format, specifically to avoid it being interpreted as a lease under the Landlord & Tenant Act 1954. What is excluded is as critical as to what has been included.

The document might be used to:

  • let spare office rooms, unused workshops or warehouse space to another business
  • bring in another trader on a shop floor
  • rent office space on a short term, flexible basis, for example as 'incubator' space for start-up businesses
  • let a parcel of spare land to another business to store vehicles or machinery"
